KCR Objects to SIT Notices, Confirms Cooperation With Probe
Former chief minister responds to SIT action
Former Telangana Chief Minister K. Chandrashekar Rao has described the notices issued to him by the Special Investigation Team (SIT) as unlawful and unconstitutional. In a written communication addressed to the investigating officer, Rao stated that the procedure adopted by the SIT violates established legal and constitutional safeguards.
Despite raising objections, Rao confirmed that he would cooperate with the inquiry process as a responsible citizen and former chief minister. He informed the SIT that he would be available at his residence in Nandinagar on the scheduled day.
Alleged violation of Supreme Court guidelines
In his letter, Rao pointed out that the issuance of notices under Section 160 of the Criminal Procedure Code was contrary to Supreme Court guidelines. He noted that individuals above the age of 65 are required to be questioned at their place of residence, as per directions laid down by the apex court.
Rao further stated that the address mentioned in his election affidavit does not correspond to the address to which the Section 160 notices were sent. He asserted that the manner in which the notices were served amounted to procedural impropriety.
Claim of right to disregard notices
The former chief minister indicated that notices issued in an unlawful manner could be ignored under law. However, he clarified that he had chosen not to do so and would extend full cooperation to the SIT. He stressed that his decision was guided by a sense of constitutional responsibility rather than acceptance of the validity of the notices.
The letter also warned that deviation from Supreme Court norms in issuing notices could be viewed as contempt of court. Rao urged the investigating agency to adhere strictly to legal procedures while conducting the inquiry.
Political context of the investigation
The SIT inquiry has attracted political attention amid ongoing exchanges between the ruling Congress government and the opposition Bharat Rashtra Samithi (BRS). Rao’s response adds a legal dimension to the ongoing investigation, particularly with respect to the procedural conduct of the SIT.
Earlier developments related to the SIT notices and the investigation have been reported in detail, including the circumstances under which the notices were issued, which can be read in the report on SIT notices to KCR in the Telangana phone tapping case published by City Buzz Daily.
The investigation is continuing, with the SIT yet to issue a formal response to the objections raised by the former chief minister.
